Terms of Use

1. Acceptance

These Terms of Use (“Terms”) are an agreement between you and DuttLabs (“we”, “us”) for the Breathe Well app and its Apple Watch app, widgets, and extensions (the “App”). By downloading or using the App you agree to these Terms and to Apple’s Licensed Application End User License Agreement (the “Standard EULA”). If these Terms conflict with the Standard EULA, these Terms apply to the extent permitted.

2. The App

Breathe Well provides guided breathing exercises with visual, audio, voice, and haptic guidance; voice journeys; guided programs and challenges; session tracking and insights; an Apple Watch app; widgets; and Siri/Shortcuts support. Features may change as the App is updated.

3. Wellness disclaimer

Breathe Well is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or condition. Content in the App is for general wellness and relaxation only and is not a substitute for professional medical advice.

If you are pregnant, have a heart, lung, or blood-pressure condition, a history of fainting or seizures, or any other health concern, talk to a healthcare professional before starting breathing exercises, especially those with long breath holds. Stop immediately and breathe normally if you feel dizzy, lightheaded, short of breath, or unwell. Never practice while driving, swimming, or in any situation where losing focus could be dangerous.

4. Premium, subscriptions & free trial

Using the App requires Breathe Well Premium, which is available as:

• Premium Monthly: $1.99 per month, auto-renewing
• Premium Yearly: $9.99 per year, auto-renewing
• Lifetime: $19.99 one-time purchase, no renewal

Prices are in US dollars, may vary by country and over time, and are always shown in the App before you confirm. Purchases are processed by Apple and subject to Apple’s terms.

4.1 Free trial

The monthly and yearly subscriptions include a 7-day free introductory trial for eligible new subscribers, as determined by Apple. The lifetime purchase has no trial. When you start a trial, you are subscribing: unless you cancel at least 24 hours before the trial ends, the subscription converts to paid and your Apple Account is charged the plan price. Any unused portion of a free trial is forfeited if you purchase another Premium option during the trial.

4.2 Auto-renewal

Payment is charged to your Apple Account at confirmation of purchase, or at the end of a free trial. Subscriptions renew automatically for the same period and price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.

4.3 Managing or cancelling

Manage or cancel any time in your Apple Account settings: on iPhone, open Settings, tap your name, tap Subscriptions, and choose Breathe Well. Cancelling stops future renewals; you keep access until the end of the current paid period.

4.4 Restoring purchases

Premium is tied to your Apple Account. Use Restore Purchases in the App on any device signed in to the same Apple Account.

5. Refunds

All payments are processed by Apple, so refund requests go to Apple at reportaproblem.apple.com. We cannot see your payment details or issue refunds directly.

6. License and acceptable use

We grant you a personal, non-transferable, non-exclusive license to use the App on Apple devices you own or control, as allowed by the Standard EULA and Apple’s Usage Rules (including Family Sharing where Apple makes it available). You agree not to:

• Use the App for any unlawful purpose
• Copy, modify, reverse engineer, decompile, or disassemble the App, except as the law allows
• Remove proprietary notices, or resell or redistribute the App or its content

7. Intellectual property

The App, including its design, text, voice journey scripts, graphics, and sounds, is owned by DuttLabs and protected by intellectual property laws. Breathing techniques themselves are traditional practices; our descriptions and presentation of them are ours.

8. Privacy

Our Privacy Policy explains how the App handles data. In short, we don’t collect personal data.

9. Disclaimer of warranties

TO THE EXTENT PERMITTED BY LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT PROMISE ANY PARTICULAR HEALTH OR WELLNESS OUTCOME, OR THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF OR INABILITY TO USE THE APP, ANY INTERRUPTION OF THE APP, OR ANY BUGS OR ERRORS IN IT.

Nothing in these Terms limits any rights you have under consumer protection laws that cannot be excluded by agreement.

11. Indemnification

You agree to indemnify and hold harmless DuttLabs from claims, damages, losses, and expenses arising from your use of the App in violation of these Terms.

12. Changes and termination

We may update these Terms. If we do, we will post the new version here and update the date above; continued use after that means you accept the changes. Your license ends automatically if you breach these Terms. Sections 3, 7, 9, 10, and 11 survive termination.

13. Governing law

These Terms are governed by the laws of the United States, without regard to conflict-of-law provisions, except where the law of your country of residence requires otherwise.
